postheadericon Bad Week For Carmen Ortiz: Admits To Botched Gang Arrest As Congress Kicks Off Swartz Investigation

Carmen Ortiz is not having a good month. The U.S. attorney who was sued by Aaron Swartz ridiculous - and today more than 50,000 people asking the White House to turn - now face a formal investigation by the Congress in this particular case. Some members of Congress from both parties, Darrell Issa and Elijah Cummings - which are essentially the top of each of the parties in the Committee on oversight and government reform - officially began their investigation. They ask these specific questions:
  • What factors influenced the decision to prosecute Mr. Swartz for the crimes alleged in the indictment, including decisions regarding the crimes charged and the filing of the indictment?
  • Mr. Swartz was opposition to SOPA or in combination with any pressure group among the factors taken into account?
  • What specific advocacy tender was made to Mr. Swartz, and what factors have influenced the decisions of prosecutors in connection with the offer made at the request of Mr. Swartz?
  • How
criminal charges, penalties sought, and offers guilty plea in this case compared to other cases that have been treated or considered prosecution under the Act fraud and abuse?

Does the federal investigation of Mr. Swartz reveal evidence that he had committed other violations of piracy? What factors influenced the decisions of the Department's proposed penalty?

But of course, this is not all that weighs on Carmen Ortiz. Last week, he said, lost a highly questionable trial in which it appears she tried to take over a family motel based on false charges of drug trafficking, but there were no problems with the many drugs out there (less than others in the area)

motel owners had worked with the police to try to stop them.
AND ... This is not all. Today's news of even greater shame because it seems that Ortiz had to go to court to admit that his office has arrested the wrong person in a band shot a few weeks ago. Basically, his office came to the conclusion - weeks later - one of the boys arrested may only seems
the kind he wanted.
