shows us the news of the promulgation of the Law on the prevention of cybercrime law of the Philippines, 2012, which has a number of interesting and troubling provisions. EFF emphasizes rightly that for defamation online criminal

rather than tort, which could lead to jail. Note that this provision appears to violate Human Rights Council of the UN, which stipulates that criminal sanctions against defamation are a problem. It is also worrying that the item was added by Senator Vicente Sotto III, without a public hearing, after Sotto stated that "the introduction of laws on defamation on the Internet make people more cautious line." But what caught my attention is that some sections of defamation. seems cybersex is now a crime in the Philippines as well. In section showing the "content-related offenses," the number one on the list is as follows:
Cybersex
. - Voluntary participation, maintenance, operation or control, directly or indirectly, in any lascivious exhibition of the genitals or sexual activity with the help of a computer system, please or consideration.



This formulation seems a bit odd, but it seems to indicate that it is now even ready cybersex illegal if it is made "to or for the account." People in the Philippines are very reasonable worries that the language here is quite broad. And what is the punishment? seems a little on the hard side:


Everyone convicted of an offense listed in section 4 (c) (1) of this Act, shall be punished with imprisonment of prision mayor or a fine of not less than two hundred thousand pesos (PhP200, 000.00) but not exceeding one million pesos (PhPl, 000,000.00), or both.
Prision mayor seems to mean at least six years in prison. 200,000 Philippine pesos is about $ 5000. So ... cybersex is actually a crime in the Philippines you could earn more than six years in prison ... and fines between $ 5,000 and $ 25,000.
That seems a little ... hard
